Contractual Relationship

These Terms of Use ("Terms") govern the access or use by you, an individual, from within India of applications, websites, content, products, and services (the "Services") made available by Karini BYD, a company incorporated in India, having its registered office at Kolkata. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Karini BYD. If you do not agree to these Terms, you may not access or use the Services. Karini BYD may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.

Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services.

User Registration

• To use certain features of the Service, you may be required to register for an account. You agree to:
• Provide accurate, current and complete information as may be prompted by any registration forms on the Service ("Registration Data").
• Maintain the security of your password and identification.
• Maintain and promptly update the Registration Data, and any other information you provide to Karini BYD, to keep it accurate, current and complete.
• Accept all risks of unauthorized access to the Registration Data and any other information you provide to Karini BYD.

Booking and Cancellation Policy

Booking:

• All bookings are subject to availability of the model and color chosen by the customer.
• The booking amount is non-interest bearing.
• The booking amount will be adjusted against the final invoice value of the car.
• Karini BYD reserves the right to accept or reject any booking without assigning any reason.

Cancellation & Refund:

• Delivery dates provided are estimates only. Karini BYD is not responsible for any delays in delivery due to circumstances beyond its control.
• In case of cancellation of the booking by the customer, a cancellation charge of Rs. 3,000/- shall be deducted from the booking amount and the balance will be refunded.
• The refund will be processed within 15-20 working days from the date of receipt of the cancellation request.
• No interest shall be payable on the booking amount or refund amount in any case.
• Karini BYD reserves the right to change the booking amount, cancellation charges, and refund policy at its sole discretion without prior notice.

Confidentiality

"Confidential Information" means any data or information that is proprietary to Karini BYD and not generally known to the public, whether in tangible or intangible form, whenever and however disclosed...

Delivery

• Delivery of the vehicle shall be subject to availability of stock and completion of all documentation and payment formalities.
• The customer shall be responsible for picking up the vehicle from the designated showroom at their own cost and risk.
• Karini BYD shall not be liable for any loss or damage to the vehicle once it has been delivered to the customer.

Payment Methods and Information

• All payments shall be made in Indian Rupees (INR) through approved payment modes like bank transfer, credit/debit cards, or demand drafts.
• Cash payments are subject to the limits prescribed by the Government of India from time to time.
• Any taxes, duties, or other levies imposed by the government shall be borne by the customer.

Personal/Sensitive Data

• Karini BYD collects and uses personal information to provide the services and improve customer experience.
• The customer agrees to the collection, storage, and processing of their personal data as per the Privacy Policy of Karini BYD.
• Personal data will not be shared with third parties without the customer's consent, except as required by law.

Governing Laws

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kolkata.

Disclaimer of Warranties/Liability

• The services are provided on an "as is" and "as available" basis. Karini BYD makes no warranties, whether express or implied, regarding the services.
• Karini BYD shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use of the services.
• Karini BYD does not warrant that the website or services will be uninterrupted or error-free.

Notice of Right to Use

Karini BYD grants the customer a limited, non-exclusive, non-transferable right to access and use the website and services for personal and non-commercial purposes.

Intellectual Property Ownership

• All content on the website, including text, graphics, logos, and software, is the property of Karini BYD or its content suppliers and is protected by intellectual property laws.
• The customer shall not use, reproduce, or distribute any content from the website without prior written permission from Karini BYD.

Indemnification

The customer agrees to indemnify, defend, and hold harmless Karini BYD and its affiliates, directors, employees, and agents from any claims, damages, or expenses arising out of the customer's use of the services or breach of these Terms.

Termination

• Karini BYD may terminate or suspend the customer's access to the services at any time, with or without cause, and with or without notice.
• Upon termination, the customer's right to use the services will immediately cease.

General Provisions

• These Terms constitute the entire agreement between the customer and Karini BYD regarding the services.
• If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Failure of Karini BYD to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
• Karini BYD reserves the right to modify these Terms at any time. The updated Terms will be posted on the website.
